Are Data Breaches a Serious Concern?
Data breaches and cybersecurity are a growing concern. Today’s world brings technology into almost every aspect of our daily lives – from smart devices that run our sprinkler systems to routine credit card purchases – making us vulnerable to theft or misuse of our personal information. Very vulnerable. A data hacking incident occurs every 39 seconds worldwide, affecting one in three Americans each year. Data breaches exposed 4.1 billion records in the first half of 2019. Not only are the number of security breaches going up, but they are also increasing in severity. Many large organizations have experienced significant threats of confidential data. Companies that use your personal information have a duty to keep your data safe and comply with data privacy legislation, including the California Privacy Act (CCPA) for residents of California. Cybersecurity incidents expose sensitive information that can leave victims at risk for identity theft and fraud.California Consumer Privacy Act (CCPA)
The CCPA went into effect on January 1, 2020 and is considered to be one of the broadest state-level privacy laws in U.S. history. The landmark law gives consumers more control over the personal information that businesses collect about them and permits data breach victims to seek statutory damages when certain conditions are met. The CCPA applies to companies that do business in California and collect personal information from California residents. It requires businesses to notify any California resident whose personal information was compromised as a result of a data breach. Any business notifying more than 500 California residents as a result of a single breach must also submit a sample copy of that notification to California’s Attorney General. The CCPA provides a private right of action for California residents. If your personal information is breached by an applicable business, you can collect actual monetary damages or statutory damages from $100 to $750, whichever is greater.
