One-wheeled SkateboardManufacturers must ensure that their products are safe to use. While the Onewheel can be a fun and fast way for people to get around, unfortunately, many riders have reported that they were seriously injured, or placed at risk of serious injury, due to one of the Onewheel’s several alleged safety defects. The Arnold Law Firm has filed a class-action lawsuit that claims the Onewheel device has a design flaw, or other defects, that makes riding it inherently dangerous. The lawsuit also alleges that the manufacturer of Onewheel has not complied with consumer protection and warranty laws, thereby putting consumers and users of the product at serious risk. Of the defects alleged, the most serious one causes the Onewheel to randomly and unexpectedly stop, resulting in the rider taking a “Nosedive.” This occurs because the motor can shut off without warning – no matter how fast, or slow, the Onewheel and its rider are traveling. This sudden seizure causes the rider to fly off of the board and can result in the rider slamming onto the ground nose first. When riders take a Nosedive at speeds up to 19 mph, it can lead to serious and permanent physical injuries. Whether you have experienced an injury due to Nosedive or not, your Onewheel may still be defective and may be placing you at risk. Even if you have not been injured, you might have product liability claims under various state and federal consumer protection and warranty laws. Manufacturers, like Future Motion, Inc. which makes the Onewheel, not only have a responsibility to provide safe products to the public, they must also provide consumer warranties that require repairs or refunds, in certain situations. Headquartered in Santa Cruz, California, Future Motion, Inc. is the manufacturer of Onewheel XR and Onewheel Pint. The company has sold thousands of Onewheel XR and Onewheel Pint devices nationwide.

Truck Accident

A 20-year-old man who had been married for just 12 days left home on his way to work. He was driving on Pleasant Grove Road in Sutter County in the early morning when he came upon a slow-moving truck. As he pulled out to pass the truck, the truck driver turned left in front of him. The young man attempted to steer back into his lane but his vehicle struck an un-flagged piece of metal extending from the back of the truck. He died in the resulting crash.

Expert witnesses brought in by the Arnold Law Firm proved that the truck, owned and operated by a hauling firm, should never have been on the highway that morning. Specifically, the rear and side turn signals did not work and the rear-view mirror was in a poor state of adjustment at the time of the collision. As a result, the driver, who had failed to properly inspect the vehicle before setting out that morning, couldn’t see the young man’s vehicle as it attempted to pass.

The poor condition of the truck, its lack of maintenance and the manner in which it was operated were found to be substantial factors in causing the collision that killed the young man. The testimony also established that the man had been making a lawful pass at the lawful speed limit and acted reasonably when he attempted to avoid the collision.

The man’s 20-year-old widow was awarded $3,767,000.77, his parents were awarded $185,131 and the family was reimbursed $11,899 in funeral expenses. Though money is a poor substitute for a young man’s life, this verdict demonstrates that drivers who endanger the lives of others will be held accountable for their actions.
