red-cyber-securityOn February 19, 2020, the Department of Homeland Security (DHS) alerted PaperlessPay Corp. that their clients’ employee data was for sale on the dark web. PaperlessPay Corp. confirmed that an unauthorized party gained access to their SQL service on February 18, 2020. PaperlessPay Corp. then notified its clients about the cyberattack. The company provides electronic paystubs under the product names my-eStub.com and PPCStubs.com for the staff of hospitals, utility providers, and other employers. It is unknown how many of PaperlessPay Corp.’s 1500 clients were affected by the security incident. So far, the following PaperlessPay Corp. clients have disclosed the data breach to their current and past employees:
  • Marshall Medical Center – hospital system in El Dorado County, California
  • Community Memorial Health System – hospital system in Ventura County, California
  • Orlando Utilities Commission – water & electric public utility provider in Orlando, Florida
  • Fareway Stores – Midwest grocery store company based in Boone, Iowa
  • Lee Auto Malls – automotive dealer in Maine
  • MP Environmental Services, Inc. – transportation, demolition and remediation company based in Bakersfield, California
Potentially compromised information is associated with paycheck stubs, W-2 forms, and payroll deposits, and may include:
  • Full names
  • Addresses
  • Bank account numbers
  • Social Security numbers
  • Pay and withholdings information
These employers are offering credit monitoring and identity theft protection services and are urging their employees to take precautionary measures, such as changing account passwords and temporarily freezing credit reports. PaperlessPay Corp. claims to have hosted 8 million paystubs and delivered over 106 million W-2 forms. It is unknown how many of the company’s 2.3 million enrolled users may be affected by this data breach. PaperlessPay Corp. was founded in 2007 and is based in Jacksonville, Florida. The company’s estimated annual revenues are $7 million. The company has not yet posted a public statement about the security incident or issued a formal notice to affected individuals.

Truck Accident

A 20-year-old man who had been married for just 12 days left home on his way to work. He was driving on Pleasant Grove Road in Sutter County in the early morning when he came upon a slow-moving truck. As he pulled out to pass the truck, the truck driver turned left in front of him. The young man attempted to steer back into his lane but his vehicle struck an un-flagged piece of metal extending from the back of the truck. He died in the resulting crash.

Expert witnesses brought in by the Arnold Law Firm proved that the truck, owned and operated by a hauling firm, should never have been on the highway that morning. Specifically, the rear and side turn signals did not work and the rear-view mirror was in a poor state of adjustment at the time of the collision. As a result, the driver, who had failed to properly inspect the vehicle before setting out that morning, couldn’t see the young man’s vehicle as it attempted to pass.

The poor condition of the truck, its lack of maintenance and the manner in which it was operated were found to be substantial factors in causing the collision that killed the young man. The testimony also established that the man had been making a lawful pass at the lawful speed limit and acted reasonably when he attempted to avoid the collision.

The man’s 20-year-old widow was awarded $3,767,000.77, his parents were awarded $185,131 and the family was reimbursed $11,899 in funeral expenses. Though money is a poor substitute for a young man’s life, this verdict demonstrates that drivers who endanger the lives of others will be held accountable for their actions.
