data-breach-lock-blue-numbersOn September 29, 2020, CBD Industries, LLC (cbdMD) disclosed a cybersecurity incident involving their cbdmd.com website. The retailer’s e-commerce platform was hacked with malicious code that allowed customer information to be skimmed by an unauthorized third party. An unknown number of customers who placed online orders from March 30, 2020 through May 8, 2020 and May 14, 2020 through May 18, 2020 were affected. The producer and distributor of cannabidiol (CBD) products reported that compromised personal information may include:
  • First and last names
  • Email addresses
  • Billing addresses
  • Credit or debit card numbers
  • Expiration dates
  • Card security codes
  • Bank account numbers
cbdMD notified law enforcement of the data breach, submitted an 8-K filing with the Securities and Exchange Commission, and claims to have implemented additional technical security measures designed to prevent similar incidents from occurring in the future. The company is currently notifying affected customers and offering one year of identity monitoring services. Headquartered in Charlotte, North Carolina, cbdMD manufactures hemp products that are considered THC-free (with undetectable THC content), including broad-spectrum CBD oils in a range of strengths for general wellness to chronic pain relief. Founded in 2015, cbdMD now has over 100 employees and estimated annual revenues of $20 million. The 2018 Farm Bill made it legal to produce, sell, and consume hemp and hemp-derived products throughout all 50 states. These products must be derived from industrial hemp containing less than 0.3 percent THC. Tetrahydrocannabinol (THC) is a natural compound found in cannabis plants — including hemp, but to a lesser degree compared with marijuana. THC is the main psychoactive compound in cannabis that produces a “high” sensation.

Truck Accident

A 20-year-old man who had been married for just 12 days left home on his way to work. He was driving on Pleasant Grove Road in Sutter County in the early morning when he came upon a slow-moving truck. As he pulled out to pass the truck, the truck driver turned left in front of him. The young man attempted to steer back into his lane but his vehicle struck an un-flagged piece of metal extending from the back of the truck. He died in the resulting crash.

Expert witnesses brought in by the Arnold Law Firm proved that the truck, owned and operated by a hauling firm, should never have been on the highway that morning. Specifically, the rear and side turn signals did not work and the rear-view mirror was in a poor state of adjustment at the time of the collision. As a result, the driver, who had failed to properly inspect the vehicle before setting out that morning, couldn’t see the young man’s vehicle as it attempted to pass.

The poor condition of the truck, its lack of maintenance and the manner in which it was operated were found to be substantial factors in causing the collision that killed the young man. The testimony also established that the man had been making a lawful pass at the lawful speed limit and acted reasonably when he attempted to avoid the collision.

The man’s 20-year-old widow was awarded $3,767,000.77, his parents were awarded $185,131 and the family was reimbursed $11,899 in funeral expenses. Though money is a poor substitute for a young man’s life, this verdict demonstrates that drivers who endanger the lives of others will be held accountable for their actions.
