Excessive Volkswagen Emissions Detected in California
The disparity between Volkswagen's laboratory emissions testing levels and the actual level of emissions produced by certain vehicle models was first detected in the state of California. In September 2015, the California Office of Enforcement and Compliance Assurance issued Volkswagen an In-Use Compliance letter and the California Air Resources Board began an investigation into Volkswagen's alleged emissions cheating.

Defeat Devices Used to Cheat Emissions Testing
Volkswagen recently admitted to installing defeat devices on several clean diesel vehicle models. The deceptive emission control software has the ability to detect when an emission test is being performed, then signaling the vehicles emission controls to work properly. Once on the road and no longer subjected to testing, the defeat devices allow these vehicles to release as much as 40 times the legal amount of nitrogen oxides into the atmosphere -- a violation of the Clean Air Act.
Nitrogen oxides in the atmosphere are a risk to public health. In addition to forming smog, these emissions can exacerbate the health effects of soot particles in the air, which can be deadly. These soot particles are estimated to cause as many as 94 deaths in the United States each year.
Vehicles Affected by Volkswagen's Defeat Device Software
Defeat device software to override emissions controls during inspections were installed on approximately 500,000 U.S. vehicles and are presumed to be installed on around 11 million automobiles across the globe. Volkswagen has said that recalls will not begin until January 2016. Affected vehicles are no longer being sold in the U.S.
